giants territorial rights. the giants could line up 7 clubs to vote with them to stop it. the battle is between the as and giants and also with the city of oakland. again, if you remember back in september mayor quan campaigned to keep all three sports teams in oakland and hosting the oakland loves our sports team week. >> mayor quan is trying to create coliseum city. but they want to keep the as, raiders around warriors in the same complex to create a stadium mall, shopping, apartments, what not. it's the only city in the bay area that has three of the six major pro franchises. >> reporter: these guidelines would be the first significant move from the baseball commissioner's office since the committee was set up after the as first unveiled plans to move to san jose years ago. the story doesn't mention the specific guidelines and leaders of both the giants and the as

aren't commenting. live in the newsroom, cate caugiran, kpix 5. new developments in the murder case against olympian oscar pistorius. a judge may decide today whether to allow him out on bail. he is charged with the shooting death of his girlfriend. now we're learning the lead detective in the investigation is facing attempted murder charges in an unrelated shooting. also today, nike announced that it is suspending its endorsement contract with the runner. sports bar company has supplied the sprinter with running gear and special soles for his racing blades since 2007. san jose city leaders say they have no interest in competing against san francisco to host of the 2024 summer olympics. if either city decides to bid, here's what it takes to win. first a budget of at least $3 billion. that's on top of venue construction costs. other requirements, a village for 16,500 athletes,45,000 hotel rooms and a workforce

equal to half the population of oakland. it's being called an eyesore and health hazard and san jose says it needs to go. a homeless encampment has grown in the last few weeks on land under the flight path to mineta international airport. kpix 5 reporter anne makovec shows us the condition at the tent city. >> reporter: it's cold to be camping but the people behind mere along spring street say they have no other choice but to live in this shantytown. police are planning a clean-up though so they are going to have to find somewhere else to live as soon as march 4. this encampment near guadalupe river park has gotten so big, you can see it from the airplanes. 100 people living in 40 tents. the squatters started coming here last month after the city raided a nearby encampment and the setup they are living in are elaborate some with windowpanes and makeshift kitchens. >> reporter: is this a mattress?

>> it's a big old mattress wrapped in plastic and up on top of crates, i mean, you know, wood. so the rain goes under the pallet. >> reporter: now, the city has had a tough time with encampments recently. every time think clean one up, another one forms. they say it will cost about $40,000 to clean up this encampment. it is one of dozens around the city. but it appears to be the largest one right now which is why it has really caught the attention of city officials. that clean-up planned for the first week of march. live in san jose, anne makovec, kpix 5. all right, anne, thank you. anne said it is chilly out there. >> i guess, but sunshine for the weekend? let's talk to lawrence find out what's going on. >> not quite as cold as yesterday. the arctic air mass over the bay area yesterday, temperatures dropping off in the 20s and 30s in the valleys. still cold enough some 30s and 40s outside breezy approaching the coastline. looks like we are in for a very

nice day though. temperatures going to be running a little below average but comfortable in the afternoon. it's 38 degrees in san jose right now. 45 in san francisco. 41 in santa rosa. and 38 degrees in concord. high pressure trying to slide in. it's going to send the jet stream just to the north of the bay area so that will keep us dry. still a chance they could see some snow showers in lake tahoe area but not for us. we are done with the snow and the rain. looks like for the foreseeable future. temperatures will be on the cooler side though. usually in the low to about the mid-60s at this time of year. today well we are going to be cooler than that about 60 degrees in san jose. about 58 in san francisco. and 59 degrees in livermore. all right. it's traffic time. for that we head to elizabeth. >> thank you, lawrence. it's a nice time to be out on the roads so far this morning. things are busy in some spots. a lot of the overnight roadwork and incidents are gone. we have metering lights on over at the bay bridge. they just turned them on a couple of minutes ago so now we have delays in the cash lanes especially.

pretty soon there will be delays i'm sure in the fastrak lanes, as well. elsewhere to the san mateo bridge, here's a live look at 101 and trimble. this is in the south bay. 101 through san jose so far still moving at top speeds. 280 and guadalupe parkway just fine. westbound 4 this is definitely one of the slow spots always slow at this time of the morning. right there as you approach as street and westbound 580 our mobile 1 unit traveling through tracy, it's still stop and go towards about vasco road in livermore. that is traffic. back to you guys. >> thank you. we are getting a look at the three men police want to find in connection with a triple homicide in sonoma county earlier this month. the sheriff releasing photos from a video taken at a gas station in st. helena. authorities believe these men may be accomplices in the murders in forestville. the in en were driving a beige colored ford rage engineer but also may be involved in the drug deal gone bad this monday. the three were driving a beige

ford ranger. a 21-year-old woman at a bus stop at natural bridges drive near delaware was shot in the head. police released a composite sketch of the suspect and offered a $5,000 reward for information. they say the woman was shot and robbed but she is expected to fully recover a santa cruz couple has a tale to tell after fighting off two robbers who invaded their home at 4:30 yesterday morning at poplar avenue. yarry gonzalez says he and wife were awakened by the intruders. the robbers seemed incompetent he said giving them the courage to fight back. >> she picks up one of our heating bags here and she chucks it at the back of weasel's head, the smaller guy who is wielding at this point a decorative sword from my wall and a screwdriver. i started engaging the bigger guy, thug, while my wife is fighting with weasel. >> quite the character there.

gonzalez managed to tackle and detain one of the suspects until police arrived although the other got away making off with several items. some other bay area headlines on this thursday. a new lawsuit filed after a north bay school fired its head football coach in connection with a sexual hazing incident. st. patrick saint vincent in vallejo fired their head coach chris cerbone and four other coaches last month. the school expelled five varsity players after a hazing incident in the locker room was reported to the coaches. lawyers say it was a wrongful termination. a fairfield man returns to court this morning to be arraigned on murder charges with special circumstances that could lead to the death penalty. 32-year-old anthony lamar jones is accused of killing 13-year- old genelle conway allen. her body was found in a park february 1. jones was arrested a week later. police think he acted alone. the obama administration may ask the supreme court to overturn california's proposition 8. that's the voter- approved initiative that limits

about 25 minutes behind schedule got a late start out of stockton due to freight train traffic. ace train 3 five-minute delays. so a heads up. ace train a little behind schedule. otherwise bart, muni an caltrain no delays. back on the roads it's been an exceptionally quiet morning as far as the number of incidents. chp reports continue to shot not much going on. southbound 101 approaching san francisco, coming into san francisco, still moving at the limit. they were able to pick up overnight roadwork that we saw on southbound 101 approaching the waldo tunnel. elsewhere let's take a look at the milpitas ride. westbound 237 around the bend silicon valley commute, you will notice all green on the sensors all the way towards sunnyvale. no problems there. checking the east bay, westbound 80 let's take a look coming down the eastshore freeway. so far 18 minutes from the carquinez bridge to the maze. no delay yet through berkeley. this is one of our slower spots. mobile 1 has been driving

through the altamont pass and livermore and they have slow- and-go conditions especially through livermore approaching vasco road so drive time now more than a half hour between the altamont pass and 680. that's a check on your "timesaver traffic." here's lawrence. >> we are going to stay dry outside not as cold as yesterday morning. still chilly enough in spots out the door partly cloudy skies. i think as we head throughout the day we'll see a lot of sunshine, breezy in spots. temperatures below average but not bad and then dry weather continues through the weekend. high pressure just off the coastline, sending the jet stream just far enough to the north to keep us dry. but still a chance of some snow showers into the tahoe area but the temperatures are going to be remaining fairly cool for this time of year. usually we are in the low to mid-60s cooler than that by the afternoon. still not bad around much of the state. about 61 degrees in sacramento. 57 partly cloudy in fresno.

some of those snow showers up in the high mountains could see rain showers into eureka 50 degrees there and 54 degrees partly cloudy into the monterey bay. around our bay looking good. 59 in morgan hill. 60 degrees in san jose. should be about 60 in redwood city. breezy though if you plan to head to the beaches in half moon bay and pacifica mid-50s there. 50s and low 60s into the east bay. i think the north bay not bad. 61 degrees in santa rosa about 62 in sonoma. about 59 in kentfield and 58 degrees and breezy into san francisco. as we look out over the next couple of days, just some passing clouds but we'll keep things dry now. saturday and sunday maybe a weak offshore wind developing. that will clear out your skies to the coastline. the temperatures maybe some low 60s over the weekend too. nice and dry. >> not bad at all. >> all right, lawrence. good job. thank you. >> thank you so much. >> you're okay, lawrence. attorney they filed a lawsuit saying the new program violates the separation of church and state. so the district superintendent says changes have already been made removing any cultural or religious references in the yoga curriculum. >> they are going to look closely and make sure that there aren't elements of religion in the program. >> to say it's watered down or been defanged of its religious tenets is simply in this case not true. >> the program funded by yoga nonprofit group is supported by most of the parents and the student. since starting the classes in january, students appear to be much calmer. but stay tuned. >> all right. february is black history month and many schools are honoring it with special celebrations. but one bay area school honors the culture and the history all year round. and piedmont avenue elementary in oakland is this week's "cool school." >> you guys showing off, right? >> okay. keep showing off. >> reporter: pope flyne has been teaching african dancing at piedmont elementary school for 26 years now. a popular musician in ghana, pope moved to the united states to teach. >> i would teach them the groove and then say you're on your own. >> reporter: twice a week students dance for an hour before school starts. >> when they come in, they're like oh, it's cold in here you know. when get on stage, and we do all those exercises and they start dancing, they forget about it. >> when i dance, i don't have to worry about what's going on around the world. >> i love dancing. >> reporter: pope says learning rhythm is learning math, history and even something more important. >> you can see that they are really happy. they are, you know, upbeat and it give them confidence. >> reporter: the dance represents his tribe and the barter between fishermen and

farmers. it's a lesson in dance and culture in a school that's 80% african-american. >> we are all africans. so the culture is actually an open culture for all of us. >> i think it's great that even though february is black history month, we try to get our students to feel happy and proud about who they are all year. >> reporter: so with every beat and every move, students here link their past to their present. they have a lot of fun. and pope says that all of the teachers thank him because all of the kids who take his dance class before school starts are wide awake when they go to class. they are alert. they are really good in class. >> i love the one shot of the gal kind of turned around and smiled. looks like they are enjoying themselves. >> they have a lot of fun and get up early to do it.

good morning. it's thursday, february 21. i'm michelle griego. >> hi, everyone. i'm frank mallicoat. the time now is 6:30. we're following some breaking news right now. las vegas police are investigating some kind of accident and shooting along the strip there. at least three we're told were shot. details are still coming in though but we do know that las vegas boulevard is shut down. you can see a lot of law enforcement is out there. that police crime scene tape again three people are reportedly to be shot. don't have any details now but we'll check in and see if we can find more information. >> as soon as we get more information it will come your way. meanwhile, same team but perhaps a new city for an east bay sports franchise. >> new details from major league baseball and what may help the as move to san jose. kpix 5 reporter cate caugiran is in the newsroom with more. >> reporter: these details are from the "l.a.

times." the story doesn't mention specific guidelines about this move but experts say the fact that these guidelines exist doesn't necessarily mean the oakland as will move because because technically the san francisco giants have territorial rights in santa clara county. but if the as can fulfill the concerns of the m l about. the commissioner could allow the club owners to decide. the as would need 75% of the club to rescind the territorial rights. the rights the giants won't necessarily give up that easily. >> that will be the last resort. i'm sure they are going to fight this tooth and nail as hard as they can until the other owners basically somehow coerce them into deciding that this might have to be the compromise. but right now, they have the territorial rights that were given to them by the as when the giants actually were struggling well over 20 years ago. >> reporter: the giants could stop the move buy lining up 7 clubs to vote with them. these guidelines would be the first significant move from the baseball commissioner's office

committed to the race. a smaller event would mean a lot less revenue for the city. no decision on bail for the south african olympian charged with murder. today's hearing for oscar pistorius ended with no decision from the judge on the bail request. officers charged pistorius in the shooting death of his girlfriend on valentine's day. now his lawyers say the lead detective in the investigation should be replaced. that's after new details show he faces attempted murder charges in an unrelated shooting. pistorius is expected back in a courtroom tomorrow. >> two men charged with an attack on san francisco giants fan are expected back in court today. louis sanchez and marvin norwood are accused of beating bryan stow outside dodger stadium two years ago. sanchez is expected to ask for more time to prepare the case since he is now representing himself. stoas permanently disabled gay the by the attack. dozens of homeless people

say they are going to have to clear out. san jose officials will clear a tent city that sprung up on land south of mineta international airport. anne makovec smack in san jose this morning and the camp is just getting plenty of complaints. >> reporter: yes, but for people living here this is seen as a relatively nice shantytown here along spring street. you can see some of its residents starting to wake up this morning at 6:30 a.m. police are planning to raid this encampment as soon as march four. people flying over it have complained. there are about 100 people living in approximately 40 tents. plenty of them arrived last month after a nearby encampment was shut down. neighbors say this is dangerous and unsanitary. you move them and they pop up in another spot.

frustrating? >> it's frustrating but it's part of the process. >> we have to be consistent on how we work with people. if we at any to work everyone at the city believes we'll have long-term positive results. leadsers are concerned if they would allow the camp to stay it could invite people from outside the area to move in here, as well. this clean-up though will cost the city about $40,000. and in the meantime, homeless advocates are coming here to talk to some of these people about alternate places that they could live. right now live in san jose, anne makovec, kpix 5. lawrence would call the weather coming up boring. we would call it nice. >> there's always something interesting about the weather. today it's going to be breezy without rain and snow that we had the other day. that was fighting. around the bay area quiet start to the morning, not as cold as yesterday morning. partly cloudy skies out there over the bay, looking good. we are working on a nice afternoon. see a couple of ripples on the

water. we are getting a breeze on the bay. 38 degrees in concord. 38 in san jose. 45 degrees in san francisco and 37 degrees in livermore. high pressure trying to sneak in here. it's going to be slow to do so. the boundary will cause breezy conditions throughout the day today and probably the next couple of days. temperatures not bad. 50s and 60s in the east bay. breezier inside the bay. in san francisco winds and out at the coastline those temperatures holding in the 50s and 60s. more on that weekend forecast coming up. but first, let's check the roads with elizabeth. >> we are watching news coming out of vacaville westbound 80 approaching sherri glen. one lane is blocked there so it's one of the first accidents we have seen so far this morning. it's starting to stack up towards the bay bridge toll plaza. the metering lights are turned on around 6:00 so it's stacking up toward the foot of the maze 10 to 15 minutes to get on the span.

are on the scene of a shooting.. along the las vegas strip. there was some sort of shootout.. las vegas police are on the scene of a shooting and this is right on vegas strip. >> you're looking at an aerial view right now. there was some sort of shootout apparently outside of the bally's casino. cbs affiliate in las vegas report that three people are dead. at least three more are injured. it set off a five-car accident including a taxi. it burst into flames.
